Where Do You Draw The Line on Debt Harassment?

When debt gets out of hand and creditors start calling, you can most likely tolerate it for a while, but when they over step their boundaries it turns into outright harassment. The Fair Debt Collection Practices Act was created to protect consumers from being harassed and abused when it comes to debt collection. You might be asking yourself, where does one draw the line? When does debt collection fall into the category of harassment?
When is it Harassment?
Following is a list of actions that debt collectors have been known to take in efforts to collect a debt and these actions do qualify as harassment.
- The collector uses profanity, screams or yells at you
- The collector makes excessive repeated calls
- The Collector calls you names
- The collector uses false names to covertly get you to the phone
- The Collector contacts a third party (family member, child, parents, boss or other co-worker and more)
- Collector calls you at work without authorization
- The collector make threats of legal action, garnishment, arrest or repossession
- The collector asks you for a post dated check
This list is not inclusive but consumers unfortunately do receive this type of harassment and there are both state and federal laws against these activities. Creditors have the right to collect money from debtors but when it gets out of hand and moves into the category of harassment, you have legal rights.
