When Creditor Calls Turn to Harassment

The majority of people who fall into debt do not do so out of willful intent; it's normally because of some unexpected emergency that reduces their ability to keep up. When bills don't get paid, the creditors start calling and this can add to the upset that may be already taking over your life; creditors can try to make you feel guilty, get you to agree to payments that you simply can't afford or threaten you with further penalties. Some may even get rude or start calling you at work or at times that are unquestionably inconvenient. There is a solution, and consumers do have protection from bad credit collection practices.
The Fair Debt Collection Practices Act (FDCPA)
The Fair Debt Collection Practices Act was put in place for this very reason, to protect consumers from abusive creditor tactics that have entered the zone of harassment. The FDCPA can protect you from the following forms of harassment:
- Threats over the phone or in writing (wage garnishment, imprisonment, foreclosure, lawsuits)
- Calling you at home or at work if you have requested that all communications be placed in written form
- Use of profanity
- Calling at non-business hours
